Terms and conditions of use for the site

The Ministry of Culture and Sport informs you that access and use of the website www.culturaydeporte.gob.es (hereinafter ‘the Site’) and all subdomains and directives included on the Site, as well as services and contents that can be accessed through it, are subject to the terms laid out in this Legal Notice, without prejudice to the fact that access to one or more of these services or contents might require the acceptance of additional Terms and Conditions.

As such, if you do not agree with the considerations set forth in this Legal Notice, we request that you do not use the Site as any use of the Site or its services and contents shall imply acceptance of the legal terms and conditions described herein. The terms and conditions set forth in this Notice may change, and we therefore invite you to check these terms when you next visit the Site.

The Ministry of Culture and Sport reserves the right, in any moment and without prior notification to users, to modify, increase or temporarily suspend the presentation, configuration, technical specifications and services of the Site, as well as make changes with the aim of updating, correcting, modifying, adding or removing contents of the Site or its design. The content and services offered on the Site are periodically updated. Due to the fact that the information is not updated immediately, you are advised to always check the validity and accuracy of the information, services and content featured on the Site

Information obtained via the Site, as well as the answers to the questions on contact forms, are for general informational purposes and for the purposes of citizen information under the terms established under Article 4 of Royal Decree 208/1996 of 9 February, with which administrative information services and citizen attention are regulated, meaning that under no circumstances can any legally binding effect be derived.

1. Intellectual and industrial property rights

The Site’s designs and source codes, as well as its logos, branding and other distinguishing marks that appear, belong to the Ministry of Culture and Sport or collaborating entities and are protected by the corresponding intellectual and industrial property rights. Similarly, all images and other graphic elements contained on the Ministry of Culture and Sport’s server are also protected by the corresponding intellectual and industrial property rights.

Total or partial reproduction of the text provided on the Site is authorised, as long as their integrity is always maintained and the Ministry of Culture and Sport is cited as the source. For the rest of the contents, the licence prohibits the downloading of content and its private use by the user when said contents appear in full, strictly prohibiting their use, reproduction, distribution, public communication, transformation or any other similar or analogous activity, unless with express permission from the Ministry of Culture and Sport.

The Ministry and Culture and Sport declares its compliance with the intellectual and industrial property rights of third parties and as such, if you consider that the Site is infringing your rights, we request that you contact the Ministry of Culture and Sport.

2. Privacy

In accordance with Regulation (EU) 2016/679 of the European Parliament and the Council (General Data Protection Regulation, hereinafter GDPR) and Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights, the Ministry of Culture and Sport promises to comply with its obligation of secrecy regarding personal data and obligation to process them in a confidential manner. To this end, it will adopt all necessary measures to prevent the unauthorised alteration, loss, access or processing of the data. The Ministry of Culture and Sport has established all technical measures available in order to avoid the loss, misuse, unauthorised access and theft of the data provided by the users.

Citizens visit the institutional Site of the Ministry of Culture and Sport is carried out anonymously. Citizens must provide only the personal data necessary in order to access the web services for the specific management or processing for the provision of the requested service (i.e. electronic office processes, contact forms, etc.).

These data will be incorporated in the corresponding processing activities carried out by the Ministry of Culture and Sport and will be processed for the purpose of each processing in accordance with the regulations established by the GDPR on personal data protection and other implementing provisions. All processing activities are compiled in the Ministry of Culture and Sport’s processing activity register PDF, in accordance with Article 30 of the GDPR and in the detailed information PDF on each of them that is included in the portal.

The legitimacy of the processing may be based on the consent of relevant parties and/or compliance with a legal obligation and/or the completion of a mandate carried out in public interest and/or the protection of vital interests and/or the execution of a contract, in accordance with Article 6 of the GDPR.

The storage period of data will depend on the terms specified for each personal data processing. However, where appropriate, the provisions of the archive and documentation regulations shall apply.

The data collected will only be subject to transfer, where appropriate, with the prior consent of the concerned party or in accordance with the provisions of the stated legislation, or in the event of legal assumption.

Those persons whose personal data is treated by the Ministry can exercise their rights to access, rectification, erasure, opposition, limitation of processing and portability, as well as object to the making of automated individual decisions, including the creation of profiles, where applicable, in the manner set out in the GDPR with the unit responsible for the file via the electronic office form or via a request directed to the Sub-Directorate General of the Citizen Support Service, Documentation and Publications, Plaza del Rey, 1, 28004 Madrid (Spain). 3. Applicable law and jurisdiction

Spanish law shall apply in the event of dispute or conflict of interpretation of the terms that make up this legal notice, as well as any matter relating to the services of this Site. For the resolution of any conflict that may arise regarding the viewing of the Site or the use of its services, the Ministry of Culture and Sport and the user both agree to submit to the courts and tribunals of the address of the user, providing the user resides in Spanish territory.

4. Links and hyperlinks

The Ministry of Culture and Sport facilitates access to other web pages that we consider may be of interest to you. The purpose of these links is solely to provide users with information in their search for Internet resources that may be of interest. However, the Ministry does not own or review the content of these sites, and therefore cannot be held liable for the content or functioning of the linked sites, or for any potential damage resulting from the use thereof. The user assumes sole responsibility for the consequences, damages or actions that can arise from access to the linked website.

Users wishing to establish a hyperlink between their website and that of the Ministry of Culture and Sport must consider the following:

  • The establishment of a hyperlink does not in any case imply the existence of a relationship between the Ministry of Culture and Sport owner of the website in which it has been established, nor the acceptance and approval of its contents or services by the Ministry of Culture and Sport. 5. Frames

The Ministry of Culture and Sport expressly prohibits the carrying out of framing or the use by third parties of any other mechanisms that alter the Site’s design, original configuration or contents.

6. Usage statistics

The Ministry of Culture and Sport informs that the use of the Google Analytics tool on the Site are for purely statistical use.

This website uses cookies that store and retrieve information when you browse it. In general, these technologies can be used for a variety of purposes, such as, for example, recognising you as a visitor to the website, obtaining information about your browsing habits or customising the way in which content is displayed. What types of cookies are used on this website?

  • Analysis: these enable us to quantify the number of visitors to the website and thus carry out the measurement and statistical analysis of the use made by users of the services. For this purpose, your browsing on our website is analysed in order to improve the services we offer you.
